APA KATA JIKA DR SAM DIJADIKAN ‘POSTER BOY’ PN?

Belum pun kering gusi rakyat memperkatakan isu titah adendum dan Pulau Batu Puteh, kini timbul pula isu baru yang tidak kurang gemparnya dalam politik negara kita.

Isu itu ialah perletakan jawatan Dr Ahmad Samsuri Mokhtar sebagai Bendahari Agung PN.

Banyak pihak melihat perletakan jawatan Menteri Besar Terengganu itu sebagai petanda berlakunya bibit-bibit perpecahan dalam PN.

Apatah lagi, Dr Ahmad Samsuri arau lebih dikenali sebagai Dr Sam sekadar memberi bayangan yang samar-samar mengenai perletakan jawatannya.

Beliau memuat naik satu petikan daripada bekas pemain bola keranjang terkenal, Kareem Abdul-Jabbar berkenaan perletakan jawatannya itu.

“Saya cuba melakukan perkara yang betul pada masa yang sesuai.

“Ianya mungkin hanya perkara kecil, tetapi pada kebiasaannya akan membezakan antara menang dan kalah,” kata beliau yang menulis melalui Facebooknya.

Dr Ahmad Samsuri seterusnya dipetik sebagai berkata, beliau akan memberi kenyataan penuh mengenai sebab-sebab perletakan jawatannya pada masa yang sesuai nanti.

Maklumat awal daripada pelbagai sumber mengatakan, sebab utama Dr Ahmad Samsuri mengundurkan diri ialah kerana ingin mempertahankan maruah Pas di dalam PN.

Ia dikatakan kerana ramai pihak dalam Pas tidak begitu senang dengan perlantikan baru dalam kepimpinan PN yang diumumkan Muhyiddin baru-baru ini.

Dalam pengumuman tersebut, diumumkan Azmin Ali sebagai Setiausaha Agung, Ahmad Faizal Azumu atau Peja selaku Ketua Penerangan dan Mas Ermieyati Samsudin sebagai Ketua Wanita, manakala Hamzah Zainuddin sebagai Timbalan Pengerusi bersama Hadi Awang, Dominic Lau dan Punithan Paramaiven.

Dr Ahmad Samsuri dikekalkan sebagai Bendahari Agung, begitu juga Afnan Hamimi Taib Azamudden turut dikekalkan sebagai Ketua Pemuda.

Pelbagai pihak di dalam Pas dilaporkan kurang senang dengan perlantikan tersebut yang dilihat terlalu memberi kelebihan kepada Bersatu, meskipun Pas memiliki jumlah Ahli Parlimen yang lebih ramai berbanding Bersatu.

Cubaan Pas untuk melobi agar Takiyuddin Hasan dijadikan Setiausaha Agung sebelum ini juga tidak berjaya menjadi kenyataan di mana Muhyiddin tetap mahukan Azmin untuk jawatan tersebut.

Hanya diberikan jawatan Bendahari Agung dalam senarai lantikan pegawai PN dianggap seperti Muhyiddin cuba membebankan Dr Ahmad Samsuri dengan usaha mencari kewangan bagi menghadapi PRU16 akan datang.

Dengan itu, pengunduran Dr Ahmad Samsuri dikatakan sebagai protes senyap terhadap perlantikan yang dibuat Muhyiddin yang dianggap tidak adil kepada Pas sebagai parti yang lebih dominan dari segi jumlah Ahli Parlimen, kekuatan ahli dan kelebihan jentera ketika pilihanraya.

Difahamkan perletakan jawatan Dr Ahmad Samsuri tidak akan sampai ke peringkat Pas mahu meninggalkan PN, cuma mahukan kedudukan mereka lebih dihargai.

Muhyiddin dalam hal ini harus segera bertindak mencari penyelesaian, tambahan lagi mood rakyat ke arah perubahan semakin jelas kelihatan.

Jangan sampai jalan ke arah perubahan tergendala kerana timbulnya isu-isu seperti ini.

Oleh kerana Dr Ahmad Samsuri sudah mengundurkan diri sebagai Bendahari Agung, memujuknya kembali memegang jawatan yang sama barangkali tidak lagi sesuai.

Begitu juga dengan menukar Takiyuddin menjadi Setiausaha Agung dan mengugurkan Azmin turut tidak wajar dilakukan kerana akan menyebabkan timbul pula masalah yang lain.

Dalam hal ini, apa kata sementara kekal sebagai Pengerusi PN, Muhyiddin dalam waktu yang sama sedia berlapang dada meletakkan Dr Ahmad Samsuri sebagai “poster boy” dan calon Perdana Menteri dalam menghadapi PRU16 akan datang?

Lagi pula, antara parti Melayu utama di negara ini, hanya Perdana Menteri daripada Pas kita belum pernah merasa.

Dengan Dr Sam dijadikan “poster boy”, jentera Pas pasti akan lebih kuat bekerja dan memungkinkan parti itu memenangi lebih banyak kerusi Parlimen lagi.

    Orang putih kata “missing the elephants in the house”.

    Ini kerana yang berkumpul bersama tu yang Sakaw duit Rakyat Malaysia termasuk majoriti orang Melayu dan paling dahsyat adalah tang cuai dan curang hingga kehilangan Tanah jajahan Raja Melayu Johor.

    Sementara “musuh bersama” adalah PMX.

    Orang yang nak disekat selama 30 tahun lebih untuk jadi PM dan bila usaha itu gagal, berusaha pulak dah lebih 24 bulan separoh penggal PM untuk guling PMX.

    Tetapi semua yang berkumpul tak syukur nikmat Allah termasuk yang berkopiah dan bersongkok, kerana rezeki PMX adalah ketentuan Allah bukan kerana dendam si Atok Saka Kerala.

    PETALING JAYA: An analyst has challenged Dr Mahathir Mohamad’s claim that Malays have been gradually deprived of their rights and will “lose all their power” under the current government.Earlier today, the former prime minister and several Perikatan Nasional leaders said they have joined forces to oppose a “common enemy” of the Malays.

    In a Facebook post, University of Tasmania’s James Chin noted that Malays have consistently controlled major state institutions and political positions since independence. He suggested that any loss of influence is tied to their effectiveness in these roles, and not external threats.

    Chin also said any perception Mahathir may have about a loss of power for the Malays should be tempered by the fact that the two-time prime minister helmed the country for 24 years.
    “If the Malays are weak now, isn’t it because he (Mahathir) didn’t establish the groundwork and foundation for them? Why is he blaming the enemy of the Malays?” he said.
    “If Malays are losing power, isn’t it because the Malays appointed to all these key institutions didn’t perform their part?
    “Malays have privileged access to higher education, their own university, and a variety of other advantages like housing discounts. Is this under threat?”
    Chin said that while Mahathir did not specify which “common enemy” he was referring to, history suggests the 99-year-old was referring to the country’s Chinese community.
    He stressed that while the Chinese are not an existential threat to Malay political power, they are framed as such within a political narrative that emphasises ethnicity and dominance.
    He said this perception of being threatened often arises from the fear of diluting Malay political and cultural dominance, rather than from an actual capability to overthrow or significantly alter the established political order.
    Chin said the country’s biggest challenge lies in navigating towards a political system where all ethnic groups feel represented and empowered without stoking racial tensions or diminishing the cultural identity of any group, including the Malays.
    “This involves rethinking the political narrative around ethnicity and embracing a more inclusive form of governance,” he said.

    KUALA LUMPUR, Dec 12 — Only the attorney general has the authority to prosecute former two-time prime minister Tun Dr Mahathir Mohamad over the loss of Malaysia’s claim to Pulau Batu Puteh.

    Minister in the Prime Minister’s Department (Law and Institutional Reform) Datuk Seri Azalina Othman Said addressed the issue during her winding-up speech on the Royal Commission of Inquiry (RCI) report debate, following questions from several MPs about the appropriateness of prosecuting Dr Mahathir.

    “The issue of whether to prosecute or not is a matter for the attorney general, not the government. Under the Constitution, we all know that the attorney general is an independent individual. If there is a police report, the police will conduct an investigation, and then the gttorney general will decide.

    “As of today, if no report has been lodged, how can we in this House direct the police to investigate or instruct the attorney general to prosecute? That’s not how it works. What I don’t understand is why some of you refuse to read this book,” she said, referring to the RCI report.

    Earlier, Pasir Gudang MP Hassan Abdul Karim expressed his opposition to the RCI’s suggestion to lodge a police report against Dr Mahathir, citing the former prime minister’s significant contributions to the country.

    The RCI had in a 217-page report distributed to MPs recommended a criminal investigation against Dr Mahathir.

    According to the report, it can be initiated under Section 415 (b) of the Penal Code and he can be punished under Section 417 of the same Code and also under Section 418 of the same Code.

    Shortly after concluding her speech, Azalina tabled a motion to postpone the Dewan Rakyat sitting to a later date, sparking commotion from the Opposition bloc. As a result, the vote to pass the motion on the RCI report will be deferred to the next session next year.

      KUALA LUMPUR, Dec 7 — The Royal Commission of Inquiry (RCI) on Batu Puteh, Middle Rocks and South Ledge found that the decision not to proceed with the revision application on the sovereignty of Batu Puteh at the International Court of Justice (ICJ), and the interpretation of the sovereignty of the South Ledge was “untenable,” among others.

      The RCI, chaired by former chief justice Tun Md Raus Sharif, said that former prime minister Tun Dr Mahathir Mohamad’s actions had caused Malaysia to lose Batu Puteh permanently, with no avenue for appeal.

      “The commission opined that Malaysia had an arguable case, not very weak as stated by Tun Dr Mahathir. Therefore, the action of not proceeding with the case at the last moment is very regrettable,” the commission said in the declassified report released two days ago.

      The panel went on to propose a criminal investigation against Dr Mahathir for deceiving the government into surrendering Malaysia’s claim over the islands.

      These are the key elements that led the panel to suggest lodging a police report against the former prime minister:

      Dr Mahathir’s role in withdrawing the claim

      Dr Mahathir said that he did not order the solicitor general at the time, Datuk Engku Nor Faizah Engku Atek, on May 21, 2018, to discontinue the legal action. Rather, it was merely his opinion that the government should not proceed, reflected in his choice of words.

      Additionally, although Dr Mahathir only said the interpretation application should be discontinued in the letter, the RCI found basis for the SG to infer that Dr Mahathir referred to both applications to the ICJ — interpretation and revision.

      The SG at the time was not called in for the RCI due to health reasons, and her testimony was received through a witness statutory declaration.

      From this, it was found that the SG informed Singapore of Malaysia’s intention not to proceed with both applications based on the former prime minister’s letter dated May 21, 2018.

      The RCI also discovered that, on May 23 that year, the High Commission of Singapore was informed of Dr Mahathir’s intentions at 9am, both of which were before the Cabinet meeting that week.

      “The above-mentioned solicitor general’s letter does not state that the decision not to proceed with both applications was the decision of the Cabinet meeting as stated by Tun Dr Mahathir,” the RCI noted in its report.

      The RCI also noted that while the Cabinet later endorsed the discontinuation, its members had not been supplied with legal opinions by the international consultants, the pleadings, the executive summary of the pleadings and other information during the meeting.

      Former human resources minister M. Kulasegaran told the RCI that a memorandum had not been prepared for the Cabinet’s discussion on such a significant matter, as was conventional.

      The RCI noted that Kulasegaran told Dr Mahathir about his discomfort with the decision after the meeting, but did not receive a reaction.

      The RCI consequently concluded that the letter by Dr Mahathir on May 21, 2018, to the solicitor general was not his mere opinion but rather a decision.

      No breach of special agreement with Singapore

      The RCI said Dr Mahathir had conveyed to the Cabinet that Malaysia had a special agreement with Singapore not to appeal the case, and that its position was “very weak.”

      The special agreement signed between Singapore and Malaysia denotes that neither party can appeal the ICJ’s decision, which was consistent with Article 60 of the ICJ statute.

      However, a revision, which was previously pursued by the government, was completely different from an appeal and allowed in the ICJ statute.

      “The Commission is of the opinion that Tun Dr Mahathir’s views in the Cabinet Meeting dated May 23, 2018, relying on the Special Agreement as a reason for not proceeding with both applications, were inaccurate and untenable.”

      The RCI asserted the revision and interpretation application as a “continuing process” and did not breach the special agreement.

      Legal experts did not advise for discontinuation

      There were three newly discovered documents available that might make a difference in the ruling of Batu Puteh if a revision had been filed, the RCI said.

      But the former PM asserted that both applications were too weak to convince the ICJ, based on his observations of the documents that were received by the Attorney General’s Chambers in 2018, and based on his discussions with legal consultant Brendan Plant.

      In the report, Dr Mahathir said he had met with Plant prior to the briefing on May 17, 2018, which the latter has denied.

      The RCI found that Plant said Malaysia had a plausible case and a credible basis for both the revision and interpretation application despite it being difficult to make.

      “It is clear that Brendan Plant never stated that Malaysia had a very weak case in both applications. He also never stated that withdrawing both applications would have been a better option,” the RCI remarked.

      The local consultants — Datuk Firoz Hussein Ahmad Jamaluddin and Datuk Abu Bakar As-Sidek Datuk Haji Mohd Sidek — said Malaysia had an arguable case.

      Other international consultants — Professor Malcolm Shaw QC, Sir Daniel Lincoln Bethlehem QC and Plant — also did not say Malaysia had a very weak case.

      Consequently, the commission found that Dr. Mahathir had communicated to the Cabinet his personal view when he claimed that the three new documents intended to support the revision application Batu Puteh were “very weak.”

      “The Commission is of the opinion that if the three facts (new documents) were to be submitted by Malaysia in the review application were accepted by the ICJ, it could have broken the reasoning of the majority judges at the ICJ who ruled that sovereignty over Batu Puteh had passed to Singapore on the grounds that Singapore had continuously exercised control and enforcement actions (effectivités) from 1953 to 1980.

      “Malaysia must accept and come to terms with such a decision even though the loss of Batu Puteh is difficult for Malaysia, especially the State of Johor. This is because Batu Puteh belonged to the Sultanate of Johor a long time ago,” the RCI said in its report.

      The RCI’s final classified report was handed over to His Majesty the King of Malaysia Sultan Ibrahim by its chairman, on August 12 at Istana Negara.

    Kami ingin merujuk kenyataan Tun Dr Mahathir Mohamad terkait syor daripada Laporan Suruhanjaya Siasatan Diraja (RCI) Bagi Mengkaji Pengendalian Perkara Berkaitan Dengan Kes Kedaulatan Batu Puteh, Batuan Tengah dan Tubir Selatan.

    Dalam kenyataan tersebut, beliau menyatakan bahawa keputusan untuk tidak meneruskan usaha semakan dan tafsiran telah dipersetujui Jemaah Menteri pada 23 Mei 2018 yang turut dihadiri oleh kami selaku anggota kabinet.

    Ingin kami tegaskan bahawa keputusan untuk tidak meneruskan semakan dan tafsiran telah pun dibuat pada 21 Mei 2018 oleh Tun Dr Mahathir sendiri secara bertulis kepada Peguam Cara Negara tanpa merujuk kepada Jemaah Menteri dan juga turut dimaklumkan kepada pihak Singapura pada pagi 23 Mei 2018 sebelum mesyuarat Kabinet pertama diadakan.

    Selang dua hari kemudian, setelah keputusan dibuat, barulah Tun Dr Mahathir memaklumkan Jemaah Menteri dalam mesyuarat Kabinet. 

    Ingin kami tekankan di sini, ianya hanyalah “pemakluman” di bawah agenda “Hal-hal lain” dan bukannya perbincangan untuk menentukan keputusan. Oleh yang demikian, tidak wujud isu sama ada sesiapa membantah atau menyokong kerana ruang untuk membuat keputusan telah pun hilang apabila ia telah dibuat secara bertulis oleh Tun Dr Mahathir.

    Sebagai negarawan, kami berpandangan Tun Dr Mahathir sepatutnya mengambil tanggungjawab sepenuhnya di atas keputusan ini dan bukannya memilih untuk meletakkan di bahu mereka yang tidak terlibat.

    Kami yakin dan percaya anggota Jemaah Menteri yang hadir dalam Mesyuarat Kabinet pada 23 Mei 2018 boleh mengesahkan perkara ini.

      Tiga orang bekas menteri sewaktu Pakatan Harapan 1.0 menepis kenyataan dibuat Tun Dr Mahathir Mohamad yang mendakwa Jemaah Menteri waktu itu bersetuju dengan keputusan untuk tidak meneruskan semakan Pulau Batu Puteh.

      Bekas Timbalan Perdana Menteri, Datuk Seri Dr Wan Azizah Wan Ismail; bekas Menteri Pertahanan, Datuk Seri Mohamad Sabu dan Menteri Pengangkutan, Anthony Loke Siew Fook menegaskan dakwaan dibuat Mahathir adalah tidak benar.

      Kata ketiga-tiga pemimpin tertinggi PH itu, keputusan untuk tidak meneruskan semakan dan tafsiran telah pun dibuat pada 21 Mei 2018 oleh Tun Dr Mahathir sendiri secara bertulis kepada Peguam Cara Negara tanpa merujuk kepada Jemaah Menteri.

      Keputusan itu juga dimaklumkan kepada pihak Singapura pada pagi 23 Mei 2018 sebelum mesyuarat Kabinet pertama diadakan.

      Terdahulu Mahathir berkata beliau tidak membuat keputusan sendiri dalam isu RCI Batu Puteh, sebaliknya ia dilakukan atas persetujuan Kabinet ketika itu.
      “Ia bukan saya seorang, ia adalah (persetujuan) Kabinet,” kata Mahathir.
      Susulan itu dalam kenyataan bersama antara bekas menteri PH hari ini, mereka menegaskan tidak wujud isu sama ada sesiapa membantah atau menyokong kerana ruang untuk membuat keputusan telah pun hilang apabila ia telah dibuat secara bertulis oleh Tun Dr Mahathir.
